Inherited a Newport Beach Home but Live Out of State? A Checklist for Remote Heirs

How do you handle an inherited Newport Beach home when you live out of state?

You do it in 3 stages: protect the house in the first 30 days, meet the property tax deadlines that start at the date of death, and then decide whether to sell, rent, or keep it, using a local team so you don't have to fly back for every step. Most of the work can be done by phone, email, and mail-away signing. What can't be done remotely is looking after an empty house, and that is where out-of-state heirs most often lose money.

We get this call often. A parent passes, the children live in Denver, Austin, or Seattle, and suddenly someone 1,000 miles away is responsible for a house near the coast. This post is the checklist we walk them through.

Key takeaways

  • Call the homeowner's insurance company in the first week. Many policies limit coverage once a home has been empty for 30 to 60 days.
  • The property is treated as changing ownership on the date of death, and a Change in Ownership Statement (BOE-502-D) is generally due to the Orange County Assessor within 150 days.
  • Only the successor trustee or the court-appointed executor can sign a listing agreement or a deed. Sort out who that is before you hire anyone.
  • Almost every step of a sale can be signed from another state through a mobile notary or a mail-away signing arranged by escrow.
  • Renting the home from out of state is possible, but you take on California landlord rules and lose any chance at the family-home property tax exclusion.

What should you do in the first 30 days?

Before anyone talks about selling, protect the asset. An empty house in a coastal climate collects problems fast: a slow leak, a broken irrigation line, a break-in, or a stack of mail that tells everyone no one is home.

Call the insurance company

This is the step heirs most often skip. Most homeowner's policies are written for an occupied home. Many limit or exclude coverage for theft, vandalism, and sometimes water damage once a home has been unoccupied for a set period, often 30 to 60 days, as GEICO's guide to insuring an unoccupied house explains. Tell the carrier the owner has passed, ask how the policy defines vacancy, and ask whether you need a vacancy endorsement or a separate vacant-home policy. Get the answer in writing.

Secure the house

  • Change or rekey the locks and keep a list of everyone with a key or garage code.
  • Keep electricity and water on so lights, alarms, irrigation, and any pool equipment keep running.
  • Forward the mail through the Postal Service so bills and tax notices reach you.
  • Remove valuables, documents, and medications, and photograph each room as it stands today.
  • Line up a local person, a neighbor, a property manager, or our team, to walk through the home every week.

Find the paperwork

Look for the trust or will, the most recent property tax bill, the deed, HOA statements, and any mortgage or reverse mortgage statements. The trust or will tells you who has authority, and the tax bill shows the parcel number you will need for every filing.

Who has the authority to act for the house?

Being an heir is not the same as having authority. If the home was held in a living trust, the successor trustee named in the trust can generally manage and sell it. If it passes under a will or with no will, a court usually has to appoint an executor or administrator in probate first. Until that happens, no one can sign a listing agreement or a deed.

If you are the trustee or executor, our guide to what a trustee or executor owes the heirs when selling a Newport Beach home covers your duties. If you are deciding between probate and a trust sale, see selling a home through a trust or probate in Orange County. An estate attorney should confirm authority before any contract is signed.

Which property tax deadlines start at the date of death?

For property tax purposes, the home changes ownership on the date of death, not when the deed is recorded. The State Board of Equalization's information sheet on the death of a real property owner says the Change in Ownership Statement, form BOE-502-D, must be filed within 150 days after the date of death, or sooner if the estate is in probate. The trustee files it for a trust, and the personal representative files it in probate. It goes to the Orange County Assessor.

The other clock is the Prop 19 family-home exclusion, which only helps if a child or qualifying grandchild moves in and makes the home their own principal residence. If no heir is moving to Newport Beach, that exclusion will not apply, and the home will generally be reassessed to market value as of the date of death. We explain the 1-year move-in rule in detail in Prop 19 and an inherited home.

Keep paying the property tax installments. In Orange County they are due November 1 and February 1 and become delinquent after December 10 and April 10. A late installment adds a 10% penalty, and an empty house is exactly where a missed bill goes unnoticed.

Can you sell the house without flying back?

Usually, yes. Here is how each step works from a distance:

Step How it works from out of state
Valuation We walk the home, pull comparable sales, and send you a written pricing analysis with photos.
Cleanout and repairs We coordinate estate sale, donation, haul-away, cleaning, and repair vendors, and send photo updates and invoices.
Listing agreement and disclosures Signed electronically by the trustee or executor.
Showings and inspections Handled locally. You review reports and offers by video call.
Closing documents Escrow arranges a mobile notary in your city or a mail-away signing for the deed and other notarized papers.
Proceeds Wired to the trust or estate account after you confirm the wiring instructions by phone with a number you already know.

The one rule we hold firm on: never send money or change wiring instructions based on an email alone. Out-of-state sellers are a favorite target for wire fraud because they can't walk into the escrow office.

If the house needs work, we keep it to what buyers in that neighborhood actually expect. Our list of what not to fix before selling explains why. If you're facing decades of belongings, our guide to clearing out a family home before selling lays out the order we follow.

What about renting it out instead?

Some families want to hold the house and rent it. That can work, but go in with your eyes open:

  • Property tax. A rental is not a principal residence, so the Prop 19 family-home exclusion does not apply. Expect the tax bill to reset to today's value.
  • Landlord rules. California has statewide rent-increase limits and just-cause eviction rules for many rentals. The California Attorney General's landlord-tenant page is a good starting point.
  • Management. From another state, you will need a licensed property manager for showings, repairs, and rent collection.
  • Several heirs. Renting means co-owning a business with your siblings. Our post on inheriting a house with siblings covers buyouts and what happens when you disagree.

What taxes come with selling an inherited home from out of state?

Often less than people fear. Inherited property generally receives a stepped-up basis equal to its market value at the date of death, which is explained in IRS Publication 551 and in our post on step-up in basis on an inherited California home. If you sell soon after the death, the taxable gain is often small.

California taxes the gain on California real estate even if the seller lives in another state. California also has a withholding system for real estate sales, but the Franchise Tax Board's Form 593 instructions include an exemption when the property was the decedent's principal residence and is sold by the estate or trust. Your CPA and escrow officer will confirm which box applies.

Frequently asked questions

Do I have to come to California to sell my parent's house?

Usually not. The trustee or executor can sign the listing agreement and disclosures electronically, and escrow can arrange a mobile notary or mail-away signing for the documents that must be notarized. Many of our out-of-state sellers never fly in.

How long can an inherited house sit empty before insurance becomes a problem?

It depends on the policy, but many limit coverage after 30 to 60 days of vacancy. Call the carrier in the first week and ask whether you need a vacancy endorsement or a separate vacant-home policy.

What form do I file with the Orange County Assessor after a death?

The Change in Ownership Statement for the death of a real property owner, form BOE-502-D. It is generally due within 150 days of the date of death, or sooner if the estate is in probate. The trustee or the personal representative files it.

Will the property taxes go up if no one moves in?

Generally yes. Without an heir moving in, the Prop 19 family-home exclusion does not apply, and the home is reassessed to its market value as of the date of death.

Can I rent the house from another state?

Yes, with a licensed property manager. You will follow California landlord rules, and the property tax will reset because a rental is not anyone's principal residence.

Will California withhold tax from the sale if I live out of state?

Not necessarily. Form 593 has an exemption when the home was the decedent's principal residence and the estate or trust is the seller. Escrow and your CPA will confirm which exemption, if any, applies.
